In 2022, President Biden pardoned persons federally convicted of simple possession. The state governments of Pennsylvania, Oregon, and others have instituted clemency programs and pardons for low-level drug offenders. Many states already limit employers’ abilities to make hiring decisions based on offenses that have been sealed, expunged, or pardoned. If you have been charged, but not convicted of simple possession, that charge may still show up in a potential employer’s routine background check.
